Acceptable Use Policy — Apex Cloud Host LLP

1. Introduction

This Acceptable Use Policy ("AUP") governs your use of domain registration and related services provided by Apex Cloud Host LLP ("Apex", "we", "our", "us"), a limited liability partnership registered in India.

By registering a domain or creating an account with Apex Cloud Host LLP, you agree to comply fully with this AUP, our Terms of Service, and Privacy Policy. This policy applies to all customers, users, resellers, and any third parties who use our services.

2. Scope & Application

This AUP applies to all services offered by Apex Cloud Host LLP, including but not limited to:

Domain registration and transfer
DNS management services
WHOIS privacy protection
Reseller and API access
Client area and dashboard

Resellers are responsible for ensuring that their end customers also comply with this AUP. Any violations by your end customers may result in action against your reseller account.

3. Prohibited Uses

You may not use our domain services for any of the following purposes:

Illegal activity — Any activity that violates applicable Indian or international laws and regulations
Fraud — Registering domains to deceive, defraud, or mislead consumers or businesses
Phishing — Setting up domains to impersonate legitimate businesses, banks, government entities or other organizations to steal credentials or financial information
Child exploitation — Any content involving the exploitation, abuse, or endangerment of minors
Terrorism — Supporting, financing, promoting or facilitating any terrorist activity
Drug trafficking — Selling, promoting or facilitating illegal drug purchases
Weapons trafficking — Promoting illegal sale or distribution of weapons
Gambling without license — Operating unlicensed gambling services
Hate speech — Content that promotes discrimination, violence, or hatred based on race, religion, gender, nationality, disability, or sexual orientation

4. Domain Name Abuse

The following domain registration practices are strictly prohibited:

Cybersquatting — Registering domain names in bad faith with intent to profit from trademarks
Typosquatting — Registering misspellings of popular domain names to capture traffic or deceive users
Fake renewal notices — Using domains to send fraudulent domain expiry or renewal notices
Fictitious registrant information — Providing false, inaccurate or misleading WHOIS contact information
Proxy abuse — Using WHOIS privacy to circumvent legitimate investigation of domain abuse

Apex Cloud Host LLP reserves the right to verify registrant information and may require documentation to confirm identity at any time.

5. Spam & Bulk Email Policy

You may not use domains registered with us to:

Send unsolicited bulk email (spam) or operate open mail relays
Harvest email addresses or personal data without consent
Conduct bulk outreach campaigns that violate India's TRAI regulations or CAN-SPAM laws
Operate email campaigns that generate significant abuse complaints

We actively monitor for domains involved in spam campaigns and will suspend accounts with repeated violations.

6. Intellectual Property Rights

You agree to register and use domain names only in a manner that does not infringe upon the intellectual property rights of others, including trademarks, copyrights, and service marks.

Apex Cloud Host LLP will respond to valid legal takedown notices in accordance with applicable law, including India's Information Technology Act, 2000 and ICANN's UDRP (Uniform Domain-Name Dispute-Resolution Policy).

7. Malware & Security Threats

You may not use our services to distribute, host, or facilitate:

Malware, ransomware, spyware, trojans, or any malicious software
Botnet command-and-control infrastructure
DDoS (Distributed Denial of Service) attack tools or services
Exploit kits or hacking tools targeting third-party systems without authorization
Cryptomining scripts or unauthorized resource consumption tools

8. Reporting Abuse

If you believe a domain registered through Apex Cloud Host LLP is being used in violation of this AUP, please report it to us:

Include: The domain name, type of abuse, evidence/URLs, and your contact information

We aim to respond to all abuse reports within 24 hours. Valid reports of severe abuse (phishing, malware) will be actioned within 4 hours.

9. Enforcement

Apex Cloud Host LLP reserves the right to:

Suspend or terminate accounts that violate this AUP without prior notice
Place domains on serverHold or clientHold status pending investigation
Report illegal activity to relevant law enforcement authorities
Cooperate fully with legal requests and court orders
Deny registration or transfer of domains we deem likely to be used for abuse

Repeated or severe violations will result in permanent account termination without refund.

10. Changes to this Policy

We reserve the right to modify this AUP at any time. Material changes will be notified to registered customers via email at least 14 days before taking effect. Continued use of our services after the effective date constitutes acceptance of the updated policy.
